India’s Top Lawyer Harish Salve All Set to Represent IOA in Vinesh Phogat Case

India’s leading lawyer, Harish Salve, will represent the Indian Olympic Association (IOA) at the Court of Arbitration for Sport (CAS) hearing on Friday concerning wrestler Vinesh Phogat’s disqualification from the Paris Olympics.

Salve, a former Solicitor General of India, confirmed his role in the case. The ad hoc hearing is set for 9:00 AM Paris time (12:30 PM IST). The CAS has established a special division in Paris, headed by US President Michael Lenard, to address cases during the Olympics.

On Wednesday morning, United World Wrestling, the sport’s governing body, disqualified Phogat for being 100 grams—about a fifth of a pound—over the weight limit. As a result, she missed the opportunity to become India’s first woman to compete in an Olympic final.

Phogat announced her retirement, stating, “My courage is broken; I don’t have any more strength now. Goodbye Wrestling, 2001-2024.”

Phogat had defeated four-time world and defending Olympic champion Yui Susaki of Japan on Tuesday. She then secured victories in her quarterfinal match against Ukraine’s Oksana Livach (7-5) and her semifinal against Cuba’s Yusneylis Guzman Lopez (5-0), seemingly setting her up for a spot in Wednesday night’s championship match.

In response to the disqualification, Haryana Chief Minister Nayab Singh Saini declared on Thursday that Phogat will be awarded all the benefits of a silver medalist, despite her disqualification.

“Not just Haryana, but the whole country is proud of our daughter Vinesh. Some issues led to her disqualification, but the state government has decided to reward her as if she were a silver medalist. We cannot let her morale suffer,” said CM Saini.

He also criticized the opposition for politicizing the issue and emphasized the central government’s efforts to “boost the morale” of the country’s athletes.

Supreme Court Smashes Mumbai College For Banning Hijab

On Friday, August 9, the Supreme Court stayed a circular from NG Acharya and DK Marathe College in Mumbai that banned the wearing of hijabs, niqabs, burqas, caps, and similar attire. The court questioned the college’s decision, pointing out that if religious symbols were to be banned, it should have also prohibited items like tilaks and bindis, according to Bar and Bench.

The interim order was issued after Muslim women students from the private college filed a petition challenging a Bombay High Court ruling that had upheld the college’s dress code directive. The students contested the notice mandating a new dress code for the academic year starting in June, arguing it was a measure to prevent religious identification and promote a focus on education.

The case was brought to the Supreme Court after the high court dismissed the students’ plea, asserting that the dress code aimed to prevent religious markers and encourage educational focus. The Supreme Court has issued a notice to the college and scheduled a hearing for November.

During the proceedings, Justices Sanjiv Khanna and Sanjay Kumar expressed surprise at the college’s directive. Justice Khanna questioned why such a rule was necessary, asking if the college planned to enforce similar bans on other religious symbols. Justice Kumar challenged the logic behind the directive, noting that the college had operated for years without such instructions and questioned the timing and reasoning behind the new policy.

The college’s counsel argued that face-covering veils hinder interaction, and the bench agreed that such attire could be restricted in classrooms. However, the court emphasized the need for inclusive education and questioned the sudden implementation of the dress code.

Delhi Court Orders Release of Manish Sisodia

Manish Sisodia Granted Bail: The Delhi Rouse Avenue Court has issued a release order for Aam Aadmi Party (AAP) leader Manish Sisodia after his lawyers submitted two bail bonds of ₹10 lakh each, along with two sureties of the same amount, in connection with the Central Bureau of Investigation (CBI) and Enforcement Directorate (ED) cases linked to the now-repealed Delhi liquor excise policy 2021-22.

Earlier today, the Supreme Court bench comprising Justices B.R. Gavai and K.V. Viswanathan granted bail to Sisodia in the excise policy irregularities cases. The former Delhi Deputy Chief Minister will be released from jail 17 months after his arrest related to the excise policy case. He had resigned from the Delhi cabinet on February 28, 2023.

The Supreme Court imposed several conditions on Sisodia, including the surrendering of his passport and refraining from influencing witnesses.

The SC was reviewing Sisodia’s appeal challenging the Delhi High Court’s dismissal of his bail plea in cases investigated by the CBI and ED. During the hearing, Additional Solicitor General SV Raju, representing the probe agencies, had expressed concerns about potential witness tampering.

AAP welcomed the Supreme Court’s bail decision, calling it a “victory of truth” and expressing hope that other imprisoned party leaders will also receive justice.

AAP MP Sanjay Singh celebrated the Supreme Court’s ruling, describing it as a significant relief and a triumph of truth for the party. Delhi Minister and AAP leader Gopal Rai expressed his satisfaction, stating, “It’s a day of happiness for the people of Delhi and the country. Manish Sisodia had set a role model for the education revolution, yet he was unjustly imprisoned for 17 months in a fabricated case. Today, the truth has prevailed. We and all of Delhi thank the Supreme Court.”

The Delhi liquor excise policy 2021-22 was withdrawn following allegations of wrongdoing by the opposition. The CBI had accused Sisodia of playing a crucial role in the alleged criminal conspiracy and being heavily involved in the policy’s formulation and implementation to meet the conspiracy’s goals.

FTX Ordered to Pay $12.7 Billion to Customers by US CTFC

August 8 – A U.S. court has mandated that the bankrupt cryptocurrency exchange FTX pay $12.7 billion in restitution to its customers, according to the Commodity Futures Trading Commission (CFTC) on Thursday.

The CFTC Chairman, Rostin Behnam, stated that FTX misled customers by presenting itself as a secure platform for accessing crypto markets, only to misappropriate their deposits for risky investments.

The repayment order follows a settlement between the CFTC and FTX, which has agreed to a bankruptcy liquidation plan to return funds to customers whose deposits were frozen during its collapse in late 2022.

FTX has promised that customers will recover 100% of their claims based on the account values at the time of bankruptcy.

The CFTC settlement addresses a potential obstacle to repayment by ensuring that the government’s lawsuit against FTX will not diminish the funds available to customers. The CFTC has agreed to delay collecting any payments from FTX until all customer claims are satisfied, including interest.

Under the settlement, FTX is required to pay $8.7 billion in restitution and $4 billion in disgorgement, which will further compensate victims for their losses during the exchange’s downfall.

FTX has yet to comment on the matter.

Sam Bankman-Fried, the founder of FTX, was sentenced to 25 years in prison in March for embezzling $8 billion from customers. He has filed an appeal against his conviction.

FTX has used its bankruptcy to negotiate settlements with U.S. regulators and former business partners, and to sell assets acquired with misappropriated funds, including real estate and investments in crypto and technology companies.

Currently, FTX is seeking votes on its bankruptcy plan but faces resistance from some customers who are dissatisfied with the decision to repay based on significantly lower cryptocurrency prices from November 2022. India Shuts Down Visa Centers In Bangladesh

Applicants have been informed that they will receive updates on the resumption of services via SMS and are advised to collect their passports on the next working day.

The notice states, “All Indian visa application centers will remain closed until further notice due to the current instability. The date for resuming applications will be communicated via SMS, and passport collection is requested on the next working day.”

The student protests in Bangladesh, which initially aimed at removing job quotas for families of independence fighters, have escalated into broader anti-government demonstrations over recent months. This unrest reached a climax on August 4, when former Prime Minister Sheikh Hasina resigned and fled to India.

On August 7, the Indian High Commission in Dhaka evacuated non-essential staff and their families via commercial flights, although the diplomatic staff remain at the High Commission, which continues to operate.

In addition to the High Commission in Dhaka, India has assistant high commissions or consulates in Chittagong, Rajshahi, Khulna, and Sylhet.

External Affairs Minister S. Jaishankar informed Parliament on August 6 that India has been in constant communication with Dhaka authorities and the Indian community in Bangladesh.

“Throughout July, as violence persisted, we continuously urged restraint and advocated for resolution through dialogue. We also communicated these concerns to various political groups,” Jaishankar noted.

He also expressed the expectation that Bangladesh would ensure the necessary security for the Indian consulates in Chittagong, Rajshahi, Khulna, and Sylhet.

Nationwide protests have been ongoing in Bangladesh since June over a job quota bill that reserves positions for families of war veterans, with the unrest intensifying last month.

Supreme Court All Set to Deliver Verdict on Friday in Excise Policy Case

The Supreme Court is scheduled to deliver its verdict on Friday regarding Aam Aadmi Party (AAP) leader Manish Sisodia’s bail pleas in connection with corruption and money laundering cases related to the alleged Delhi excise policy scam.

According to the cause list on the Supreme Court’s website, the bench comprising Justices BR Gavai and KV Viswanathan will announce the verdict on Thursday. The bench had reserved its judgment on Sisodia’s pleas on August 6.

Sisodia was arrested by the Central Bureau of Investigation (CBI) on February 26, 2023, for alleged irregularities in the formulation and implementation of the now-defunct Delhi excise policy 2021-22. He was subsequently arrested by the Enforcement Directorate (ED) in a money laundering case linked to the CBI FIR on March 9, 2023.

Sisodia is seeking bail, arguing that he has been in custody for 17 months without the trial commencing. Both the ED and the CBI have opposed his bail applications.

During the proceedings, the Supreme Court questioned the CBI and ED about the anticipated timeline for concluding the trials, given that there are 493 witnesses across both cases. The law officer representing the probe agencies mentioned that there are eight key witnesses in each case and disputed Sisodia’s claim that delays were due to the agencies.

On July 16, the Supreme Court agreed to hear Sisodia’s pleas and requested responses from the CBI and ED. Sisodia had previously appealed to the Supreme Court challenging the Delhi High Court’s May 21 order, which dismissed his bail applications. He had also contested a trial court’s April 30 order rejecting his bail pleas.

Sisodia, a former deputy chief minister and education minister of Delhi, resigned from the Delhi cabinet on February 28, 2023.

Authorities discovered Islamic State and al-Qaida materials at the home of the second and final suspect involved in a thwarted plot to attack Taylor Swift’s now-cancelled concerts in Austria. Interior Minister Gerhard Karner stated Thursday in Vienna that no additional suspects are being pursued following the arrest of the two individuals.

“The situation was grave, it remains serious. But we can also say: A tragedy has been averted,” Karner said.

Austrian security officials revealed that the second suspect, a 17-year-old Austrian of Turkish and Croatian descent, was detained by special police forces near the stadium where the concerts were scheduled to take place this week. A 19-year-old Austrian was also apprehended. The suspects’ identities have not been disclosed due to Austrian privacy laws.

According to Austrian security officials, the suspects intended to carry out an attack outside the stadium, aiming to kill as many people as possible with knives or homemade explosives.

During a press conference in Vienna, officials noted that the primary suspect, a 19-year-old Austrian of North Macedonian origin, fully admitted to his attack plans. They described him as being “clearly radicalized towards the Islamic State and believing it is right to kill infidels.”

The second suspect had recently been employed by a company providing services at the venue during the concerts. Investigators found extensive Islamic State and al-Qaida materials at his home.

The cancellation of three sold-out concerts this week left fans devastated, many of whom had spent thousands of euros on travel and accommodations in Vienna for the Eras Tour shows at the Ernst Happel Stadium, which remained empty on Thursday morning except for media coverage.

Haryana Decides to Suspends Internet Services in Sirsa

On Wednesday, the Nayab Singh Saini government in Haryana ordered a suspension of internet services across the entire Sirsa district until midnight Thursday, following the death of Dera Jagmalwali chief Bahadur Chand Vakil last week.

Vakil, the leader of Dera Jagmalwali in Sirsa, was cremated on Friday. His followers have claimed that his death involved foul play and are concerned about the succession of leadership, as a different faction is set to take over the Dera.

Additional Chief Secretary (Home) Anurag Rastogi issued the suspension order, citing concerns about potential unrest and disturbances. The order stated, “There is a risk of tension, agitation, and disruption of public peace that could lead to damage to public and private property in the district.”

The suspension aims to curb the spread of misinformation and rumors via social media platforms such as WhatsApp, Facebook, and Twitter, as well as through SMS, which could facilitate the mobilization of agitators and demonstrators who might engage in violent activities, including arson and vandalism.

The Home Secretary directed the suspension of mobile internet services (2G/3G/5G/CDMA/GPRS), bulk SMS (excluding banking and mobile recharge), and all dongle services on mobile networks in Sirsa, while voice calls remain unaffected. The restrictions are set to be in place from August 7 at 5:00 PM to August 8 at 11:59 PM.

Exemptions from the ban include individual SMS, mobile recharge, banking SMS, voice calls, and internet services via broadband and lease lines for both corporate and domestic users.

In addition to Sirsa, Vakil’s followers in Fatehabad and other neighboring districts have also voiced suspicions about the circumstances of his death. They accuse Virender Singh Dhillon, who is poised to lead the Dera, of allegedly orchestrating Vakil’s murder and have called for a CBI investigation into the matter.
