HC Denies OpenAI’s Request to Decide on Jurisdiction First

The Delhi High Court on Tuesday rejected OpenAI’s request to first determine its jurisdiction before proceeding with the copyright infringement suit filed by news agency Asian News International (ANI). The lawsuit alleges that OpenAI has unlawfully used ANI’s original news content.

Justice Amit Bansal stated that arguments on jurisdiction would be heard alongside the merits of the case and scheduled the final hearing for February 21.

“Mr. Sibal, I will not decide jurisdiction as a preliminary issue. It will be part of the arguments,” Justice Bansal told senior advocate Amit Sibal, who appeared for OpenAI.

Sibal had contested the court’s jurisdiction over the case and urged that this issue be settled before further proceedings. Seeking the dismissal of ANI’s lawsuit, he argued that only courts in California had the exclusive authority to adjudicate the copyright infringement claims. He further contended that Indian courts lacked jurisdiction over ANI’s allegations that OpenAI used the news agency’s content to train its large language model (LLM), as the servers involved were located outside India.

The case is being closely followed, as its outcome could play a crucial role in shaping copyright law in the digital era, setting a precedent for the protection of original news content against unauthorized use by AI-driven platforms.

During the proceedings, the court also issued a notice regarding an application filed by digital divisions of three major news organizations—HT Digital Streams (HT Media), IE Online Media Services (Express Group), and NDTV Convergence—along with the industry body Digital News Publishers Association. They sought to intervene in the copyright case. Despite OpenAI’s objection that their involvement would broaden the scope of the suit, Justice Bansal directed the company to submit its response within two weeks.

ANI’s lawsuit seeks to restrain OpenAI from using its content on ChatGPT and demands the deletion of any stored ANI material. The agency alleges that OpenAI has exploited its original content for commercial gain, using it to train its AI model without acquiring proper licensing or permission. ANI is also seeking ₹2 crore in damages, accusing OpenAI of not only unauthorized copying and storage but also misattributing news content to the agency.

On November 19, the High Court issued summons in the case but declined to immediately prohibit OpenAI from publishing ANI’s content, noting that the platform had already blocklisted ANI’s domain in October to prevent further use of its material.

The court also appointed advocate Adarsh Ramanujan and Dr. Arul George Scaria, a professor of law at the National Law School of India University (NLSIU), as amicus curiae, recognizing that the lawsuit raises “novel legal issues” related to emerging technology.

The court framed four key issues:

  1. Whether it has jurisdiction to hear the case, given that OpenAI’s servers are based in the United States.
  2. Whether ChatGPT’s storage of ANI’s data for training its model constitutes copyright infringement.
  3. Whether generating responses using ANI’s copyrighted content amounts to infringement.
  4. Whether OpenAI’s use of ANI’s copyrighted data qualifies as fair use under Section 52 of the Copyright Act, 1957, which permits limited use of copyrighted material for purposes such as criticism, commentary, news reporting, teaching, scholarship, or research.

On January 10, Joint Registrar Ajay Gulati issued notice in an application filed by the Federation of Indian Publishers (FIP), which also sought to intervene in ANI’s case. FIP argued that OpenAI was using its original literary works to train LLMs. OpenAI opposed FIP’s application, asserting in an affidavit that its web crawlers did not access proprietary material behind paywalls.

During Tuesday’s hearing, the court took exception to the circulation of pleadings in the media before they were reviewed by the court. This came after Sibal pointed to multiple news reports on FIP’s application and OpenAI’s response. Justice Bansal indicated that there should be no unnecessary reporting on the submissions made by the parties, stating, “We will ask them to exercise restraint. That I am indicating. No unnecessary reporting at least on the submissions of parties.”

Responding to the criticism on Instagram, Snoop shared a video addressing the controversy. “For all the hate, I’m going to answer with love,” he said while sitting in his car, as reported by People.

“Get your life right, stop worrying about mine. I’m cool. I’m together. Still a Black man. Still 100% Black. All out ’til you ball out or ’til you fall out,” he added, according to the outlet.

Previously, Snoop discussed the backlash during an appearance on the R&B Money Podcast. “You’re gonna deal with hate when you get to the top, no matter who you are… Personally, I answer it with success and love. That’s my way of handling any hate or negativity because love is the strongest force that can defeat it,” he explained.

Snoop’s performance at the Crypto Ball in Washington, DC, on January 17 has drawn attention partly because of his past remarks. Parliament Budget Session Will Begin on January 31st With President Address

President Droupadi Murmu will address both Houses of Parliament on Friday, January 31, marking the start of the Budget session, during which Finance Minister Nirmala Sitharaman is set to present the Union Budget 2025 on February 1.

The Budget session will be conducted in two parts. The first phase will run from January 31 to February 13, while the second phase will take place from March 10 to April 4, 2025.

As per a parliamentary bulletin released on Tuesday, the Rajya Sabha will convene a separate session for government business half an hour after the President’s address. February 3-5 have been tentatively reserved for a discussion on the vote of thanks for the President’s address, which will be proposed by one MP and seconded by another.

Union Parliamentary Affairs Minister Kiren Rijiju announced on Monday that an all-party meeting is scheduled for January 30 to ensure opposition cooperation and facilitate smooth discussions during the session.

On January 23, Finance Minister Sitharaman participated in the customary Halwa ceremony, signaling the final stage of budget preparation and the start of printing for the Union Budget 2025-26. She will present the Budget in Parliament on February 1 at 11 a.m.

This will be Sitharaman’s eighth consecutive Union Budget presentation, making her the first finance minister to achieve this milestone.

A report by the Bank of Baroda outlined expectations for the Budget, stating, “The Union Budget for fiscal year 2025-26 will skillfully balance fiscal consolidation with growth-oriented measures. We expect the government to meet or even surpass its fiscal deficit target of 4.9% of GDP, due to anticipated savings on the expenditure side.”

Google Maps will update the name “Gulf of Mexico” to “Gulf of America” once the U.S. Geographic Names System officially adopts the change, the company announced on X on Monday.

In the U.S., the updated name will be visible on Google Maps, while in Mexico, it will remain “Gulf of Mexico.” In other countries, both names will appear.

This change follows an announcement by the Trump administration’s Interior Department last Friday, declaring the Gulf of Mexico officially renamed the Gulf of America. Additionally, Denali, North America’s tallest mountain, will revert to its previous name, Mount McKinley.

President Donald Trump signed these name changes into effect as part of a series of executive actions shortly after his inauguration on January 20, fulfilling a campaign pledge.

“As directed by the President, the Gulf of Mexico will now officially be called the Gulf of America, and North America’s highest peak will once again carry the name Mount McKinley,” the Interior Department stated.

Mexican President Claudia Sheinbaum, earlier this month, humorously proposed renaming North America, including the U.S., as “Mexican America,” referencing an early historic map of the region.

A Google spokesperson, when contacted, referred to the company’s X post for details. Google noted that it applies similar naming conventions in disputed regions. For example, the sea between Japan and South Korea is labeled “Sea of Japan (East Sea)” outside those nations.

Google has faced previous controversies over geographic naming. In 2012, Iran criticized Google for removing the name “Persian Gulf” from its maps, leaving the waterway between Iran and the Arabian Peninsula nameless. It is now labeled “Persian Gulf (Arabian Gulf)” in countries outside the region.

Uttarakhand has become the first state in India to implement the Uniform Civil Code, aimed at ensuring legal equality for people of all castes and religions.

The Uniform Civil Code (UCC) in Uttarakhand applies to all residents of the state, except for Scheduled Tribes and individuals or communities protected under special authority-empowered provisions.

The UCC aims to streamline and standardize personal laws related to marriage, divorce, succession, and inheritance, promoting legal uniformity.

Under the UCC:

  • Marriage can only occur between individuals who have no living spouse.
  • Both parties must be mentally capable of giving legal consent.
  • The minimum age for marriage is 21 for men and 18 for women.
  • The couple must not fall within prohibited relationships.

Uttarakhand’s path to implementing the UCC began in March 2022, when the state cabinet approved the formation of an expert committee led by retired Supreme Court Judge Ranjana Prakash Desai. The committee conducted extensive consultations over 18 months, engaging with various sections of the population, and submitted the draft UCC in four detailed volumes.

The draft was presented to the state on February 2, 2024. Shortly after, the Uttarakhand assembly passed the UCC bill, and President Droupadi Murmu granted her assent in March 2024, completing nearly two years of the legislative process.

Key Features of Uttarakhand’s UCC

The Uniform Civil Code Act in Uttarakhand regulates the following areas:

  • Marriage and Divorce: Establishes a uniform marriageable age for men and women, defines grounds for divorce, and standardizes procedures across all religions.
  • Succession: Codifies inheritance and succession laws.
  • Live-in Relationships: Mandates compulsory registration of live-in relationships.
  • Polygamy and ‘Halala’: Prohibits polygamy and bans the practice of ‘halala,’ where a woman must marry and divorce another man before remarrying her previous husband.

On Monday, the government invited applications for the position of chairperson of the Securities and Exchange Board of India (SEBI), approximately a month before Madhabi Puri Buch’s three-year tenure as head of the securities and commodities market regulator concludes on February 28. Buch assumed the role in March 2022.

The SEBI chief faced scrutiny after the now-defunct US-based short-seller Hindenburg Research alleged that Buch and her husband, Dhaval Buch, were linked to offshore entities involved in the alleged “Adani money siphoning scandal.”

These allegations ignited a political controversy, with the Opposition Congress demanding a parliamentary investigation. Meanwhile, the ruling Bharatiya Janata Party (BJP) criticized Congress, accusing it of opposing Indian companies while siding with foreign entities.

The Adani Group dismissed the claims as “malicious, mischievous, and manipulative selections of publicly available information,” while the Buchs labeled the accusations an attempt at “character assassination.”

The Union finance ministry’s economic affairs department issued a public advertisement on Monday, outlining the terms of the SEBI chairperson’s appointment. The selected candidate will serve for a maximum of five years or until the age of 65, whichever comes first. Applications must be submitted by February 17.

According to the advertisement, the chairperson will receive a monthly salary of ₹5,62,500, excluding housing and transportation benefits. It emphasized the role’s significance as a regulatory position and sought candidates with “high integrity, eminence, and reputation,” preferably above the age of 50 with over 25 years of professional experience.

The ideal candidate should have expertise in handling securities market-related issues or possess specialized knowledge in law, finance, economics, or accountancy, as deemed useful by the government. Additionally, the appointee must not have any financial or other interests that could conflict with their responsibilities as chairperson.

The SEBI chairperson is appointed based on recommendations from the Financial Sector Regulatory Appointments Search Committee. The advertisement noted that the committee reserves the right to recommend other meritorious candidates, even if they have not applied.

Congress lawmaker Manickam Tagore criticized the process, alleging the government was discreetly searching for a new SEBI chief. He referred to Madhabi Puri Buch as “Adani’s trusted lady,” thanking Rahul Gandhi for advocating for investors’ rights.

Rahul Gandhi spearheaded Congress’s attack following Hindenburg Research’s 2023 allegations against the Adani Group, accusing it of stock price manipulation. The report also alleged that Buch, while overseeing the investigation, had a stake in offshore entities implicated in the allegations.

Hindenburg’s claims, based on whistleblower documents, suggested Madhabi Puri Buch and her husband held stakes in offshore funds in Bermuda and Mauritius via complex structures. It alleged that weeks before Buch’s appointment as a full-time SEBI member in 2017, Dhaval Buch had requested a Mauritius fund administrator to grant him exclusive control over certain accounts.

Hindenburg’s January 2023 report accused the Adani Group of exploiting tax havens and manipulating stock prices, triggering a $150 billion sell-off in Adani Group stocks and prompting a SEBI investigation.

In January, the Supreme Court declined to order a separate probe into these allegations, stating there was no evidence of SEBI’s “glaring, willful, or deliberate inaction” or regulatory failure. The court also dismissed reliance on the Hindenburg report or unsubstantiated media reports as grounds for questioning SEBI’s investigation.

A petition seeking a review of the court’s decision was dismissed in July, with the court rejecting calls for a special investigation team to probe Hindenburg’s allegations, citing that third-party reports cannot serve as conclusive evidence of SEBI’s inadequacy.

In May, six Adani Group companies disclosed that they had received SEBI notices for alleged stock market norm violations. SEBI also issued a “show cause” notice to Hindenburg Research for alleged violations related to using non-public information to establish a short position. Hindenburg dismissed these accusations as “nonsense” in July.

Arvind Kejriwal responded to Yogi Adityanath’s comments on Delhi’s law and order situation, particularly regarding Bangladeshi immigrants. The Uttar Pradesh Chief Minister made these remarks during a rally in Delhi ahead of the February assembly election.

Addressing reporters, Kejriwal stated, “I would like to tell Yogi ji that law and order in Delhi fall under Amit Shah’s jurisdiction. He should sit with Amit Shah, guide him, and explain how to improve it. Amit Shah seems more focused on toppling governments and poaching MLAs.”

The former Delhi Chief Minister acknowledged that Delhi’s law and order situation was concerning, agreeing with Yogi Adityanath’s assessment. “I agree with Yogi ji that Delhi’s law and order is very bad. Eleven gangsters have taken control of the entire city. Yogi ji claims to have eradicated gangsters in Uttar Pradesh,” Kejriwal remarked. Yogi Adityanath, while addressing a crowd in the Janakpuri constituency, accused Kejriwal’s AAP government of instigating the 2020 riots in Delhi with the support of “Bangladeshi infiltrators.” He stated, “With the help of Bangladeshi infiltrators, their [AAP] councillors and officials incited riots in 2020. They created chaos and hooliganism in Shaheen Bagh. States governed by the BJP’s double-engine government offer a clean and secure environment.”

Adityanath urged voters to support a “double-engine” BJP government in Delhi, promising improved basic amenities and progress toward transforming the city into “Indraprastha.”

The Delhi assembly election is scheduled to take place in a single phase on February 5, with vote counting set for February 8.

Former US President Donald Trump revealed on Thursday that he recently had a “friendly” conversation with Chinese President Xi Jinping.

In an interview, the Republican leader expressed confidence in reaching a trade agreement with China. “It went fine. It was a good, friendly conversation,” Trump told Fox News.

Discussing the possibility of establishing fair trade practices, Trump emphasized his ability to strike a deal with Xi, whom he described as “ambitious.” “I can do that,” Trump stated.

Trump also shared details of the phone call on his social media platform, Truth Social, mentioning that the discussion covered various topics, including balancing trade, combating fentanyl, and TikTok. “We discussed balancing trade, fentanyl, TikTok, and many other subjects. President Xi and I will do everything possible to make the world more peaceful and safe!” he posted.

The call took place last Friday, just days before Trump assumed office as the 47th President of the United States. Xi expressed hope for a “good start” to their relations, while Trump voiced optimism about resolving significant issues together.

Trump’s Tariff Threat Against China

Since assuming office, Trump has proposed a 10% punitive tariff on Chinese imports, citing the trafficking of fentanyl from China into the US through Mexico and Canada. However, the tariffs have yet to be implemented, despite promises made during his campaign.

In addition to China, Trump has also threatened tariffs against the European Union, Mexico, and Canada.
