The Maharashtra government has authorized all shops and establishments, excluding alcohol-selling venues, to operate round-the-clock, according to an official circular issued by the Industries, Energy, Labour and Mining Department.

The government clarified that most commercial establishments across the state can now remain open 24 hours a day. The only exceptions are businesses that serve or sell alcohol, including permit rooms, beer bars, and wine shops, which must continue adhering to regulated operating hours.

The decision follows multiple complaints received by the Maharashtra government regarding local authorities and police preventing businesses from operating 24/7. The notification aims to address inconsistent enforcement and provide clear guidelines to law enforcement agencies and municipal administrations.

Employee Protection Measures

Under the Maharashtra Shops and Establishments Act, 2017, businesses choosing to operate continuously must provide every employee a mandatory weekly break of 24 consecutive hours. This requirement ensures worker welfare remains protected despite extended operating hours.

Theatres and cinemas, previously included among establishments with regulated hours, have been removed from the restricted list and can now operate 24/7. This change provides additional flexibility for the entertainment sector.

Implementation and Enforcement

The government has notified local administrations and police departments about the clarification to ensure proper implementation. The circular aims to eliminate confusion and prevent arbitrary restrictions on businesses that comply with labor regulations.

The policy is expected to stimulate business activity and provide greater operational flexibility for establishments throughout Maharashtra.
