In a comprehensive statement filed with stock exchanges, the Adani Group has strongly contested media reports alleging bribery charges against its top executives. It maintains that key company leaders have been misrepresented in the recent US Department of Justice (DoJ) indictment.

Adani Group refutes US Bribery charges

The group’s statement, issued by Adani Green Energy Ltd. (AGEL), categorically denies that Chairman Gautam Adani, his nephew Sagar Adani, and senior executive Vneet Jaain have been charged with violations under the US Foreign Corrupt Practices Act (FCPA).

Diving into the legal nuances, the group highlighted that the five-count DoJ indictment does not include Gautam Adani, Sagar Adani, or Vneet Jaain in the first and fifth counts, which relate to “Conspiracy to Violate the FCPA” and “Conspiracy to Obstruct Justice” respectively.

Speaking at a press conference, senior lawyer Mukul Rohatgi emphasized the lack of substantive evidence, noting that there are “no details in the chargesheet about who has been bribed.”

The Adani Group stressed that the indictment relies solely on claims of discussed or promised bribes, without providing concrete evidence of actual bribery to Indian government officials. “All of this is based on likelihoods and hearsay from former employees of Azure Power and CDPQ places the US DoJ’s and US SEC’s action against Adani on dangerously shaky ground – both morally and legally,” the statement asserted.

The group pointed out that Adani officials are only charged under three specific counts: “Alleged Securities Fraud Conspiracy,” “Alleged Wire Fraud Conspiracy,” and “Alleged Securities Fraud.”

‘Not Adani nor his nephew involved in the Bribery’

The first count of the indictment exclusively involves Ranjit Gupta, Cyril Cabanes, Saurabh Agarwal, Deepak Malhotra, and Rupesh Agarwal from Azure Power and CDPQ, with no Adani officials named in this section.

Why did US prosecutors indict Gautam Adani?

The fallout from these allegations has been significant. The Adani Group reports a substantial market capitalization loss of nearly US$55 billion across its 11 listed companies. The group criticized “reckless false reporting” for causing “international project cancellations, financial market impact, and sudden examination from strategic partners, investors, and the public.”

Contextualizing the situation, the statement highlighted the group’s expansive global operations, positioning Adani as a major infrastructure player with a significant international presence. The group competes directly with US and Chinese entities in markets across Africa, Bangladesh, Sri Lanka, Israel, and Australia.

In its official filing, Adani Green Energy Ltd. explicitly stated: “Media articles which state that certain of our directors namely Mr. Gautam Adani, Mr. Sagar Adani and Mr. Vneet Jaain have been charged with violation(s) of the US Foreign Corrupt Practices Act (FCPA) in the indictment. Such statements are incorrect.”

The group emphasized that a “flawed understanding” of the DoJ indictment has led to widespread misinformation, urging a more careful and accurate interpretation of the legal document.
